Terms of Service

Acceptance of these terms

HSA Buddy is an iOS app published by Alpine Software (“we”, “us”). By downloading, installing, or using the app, you agree to these Terms of Service. If you do not agree, please do not use the app.

You must be at least 13 years old to use HSA Buddy (or the minimum age required to consent to online services in your country or state, if older). By using the app you represent that you meet this requirement.

What HSA Buddy does

HSA Buddy helps you save receipts and track health-related reimbursements. With your permission, it signs you in with your Google account and creates and updates a single spreadsheet in your own Google Drive to store the receipts and reimbursements you log in the app.

HSA Buddy is a productivity tool. It is not a financial, medical, tax, legal, or insurance service, and nothing in the app is professional advice. You are responsible for confirming eligibility of expenses with your HSA/FSA administrator, your tax professional, or other qualified advisors.

Your Google account and data

You control the Google account you sign in with and the spreadsheet HSA Buddy creates in your Drive. You can revoke the app's access at any time from your Google account permissions page and delete the spreadsheet from Drive. How HSA Buddy handles Google user data is described in our Privacy Policy.

Acceptable use

You agree not to misuse the app. In particular, you will not:

  • Use HSA Buddy in violation of any applicable law, regulation, or third-party right.
  • Attempt to reverse engineer, interfere with, or disrupt the app, its servers, or the third-party services it relies on.
  • Use the app to store or transmit content you do not have the right to store or transmit.
  • Use automated means to access the app in a way that burdens or abuses the service.

Third-party services

HSA Buddy relies on third-party services, including Google (sign-in, Sheets, and Drive), Apple (App Store, iOS), and Google AdMob (to serve ads that help keep the app free). Your use of those services is also governed by their own terms and privacy policies. We are not responsible for third-party services or any changes they make.

Advertising

HSA Buddy may show ads via Google AdMob. Ads are provided by third parties and are not endorsements. We do not share your receipts or reimbursement data with advertisers.

No warranty

HSA Buddy is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any data will be preserved or recoverable. You are responsible for keeping your own backups where appropriate.

Limitation of liability

To the maximum extent permitted by law, Alpine Software will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of HSA Buddy. Our total liability for any claim arising out of or relating to the app will not exceed the greater of (a) the amount you paid us to use the app in the twelve months before the claim, or (b) USD $20.

Indemnification

You agree to defend, indemnify, and hold harmless Alpine Software and its officers, employees, and contractors from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to (a) your use of HSA Buddy, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual-property or privacy right.

Apple App Store

HSA Buddy is distributed through the Apple App Store. You acknowledge that:

  • These Terms are between you and Alpine Software. Apple is not a party to these Terms.
  • Alpine Software, not Apple, is solely responsible for HSA Buddy and its content. Apple has no obligation to furnish any maintenance or support services with respect to the app.
  • In the event of any failure of HSA Buddy to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the app.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and, upon your acceptance of these Terms, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  • You represent and warrant that you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.

Changes to the app and these terms

We may update, change, or discontinue features of HSA Buddy at any time. We may also update these Terms as the product evolves. Material changes will be reflected by updating the “Effective” date above and, where appropriate, by notice in the app. Your continued use of the app after an update means you accept the revised Terms.

Termination

You can stop using HSA Buddy at any time and revoke the app's access to your Google account. We may suspend or terminate access to the app if we reasonably believe it is being misused or if required by law.

Governing law

These Terms are governed by the laws of the United States and the State of Michigan, without regard to conflict of law principles. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Michigan, and you consent to personal jurisdiction there.

Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Alpine Software regarding HSA Buddy and supersede any prior agreements on the same subject. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
